To be commercial or not to be commercial!

In TFN’s case against Tim Oey I believe that one of the arguments used is that Tim Oey was attempting to set up a rival commercial organisation.

Now I may not have the wording right, but if Tim Oey had created a rival commercial organisation as Deron Beal argues then does not that mean that TFN is a commercial organisation as well?  You with me so far?

Well, it seems that Deron is yet again attempting to get TFN into hot water.  The reason is that Yahoo’s TOS explicitly forbid commercial activities.

So Deron you cannot sue Tim Oey on the grounds of him creating a rival commercial organisation if at the same time TFN is NOT commercial.

Therefore, Deron your choice is whether to be commercial and attempt to win a lawsuit in the 9th court ORuse Yahoo Groups.  But you cannot have both.
